Replication has been filed to written statement of defendant
no.1 and to written statement of defendant no.2 and 3 separately. Copies
supplied.
Affidavit of admission / denial of documents has been filed
on behalf of plaintiff.
Counsel for the parties state that mediation is not possible at
this stage.
Counsel for the defendants no.2 and 3 states that he is not
filing of affidavit of admission / denial of documents.
Proxy counsel for the defendant no.1 seeks time to file
affidavit of admission / denial of documents.
Request is strongly opposed.
In view of the opposition by counsel for the plaintiff,
adjournment to proxy counsel for the defendant no.1, is denied.
Framing of issues is pressed for.
Pleadings of the parties are complete. From the pleadings of
the parties, following issues are hereby framed :
1. Whether the plaintiff is entitled to Rs.6,80,000/- alongwith interest

@ 18% per annum w.e.f. 16.05.2023 till realization ? OPP
2. Whether the suit is bad for mis-joinder of necessary party i.e. Gram
Sabha / BDO ? OPD-1
3. Whether the suit of the plaintiff is not maintainable as no
cancellation of agreement to sell dated 25.05.2023 has been sought
and possession has not been returned to the defendants no.2 and
3 ? OPD -2 and 3
4. Relief.
No other issue arises or is pressed for.
List of witnesses, if any, be filed by both the parties within 15 days
from today.
Now, to come up for PE by way of affidavit on 16.07.2026.
Advance copy of affidavit of witnesses be supplied to the opposite
party at least one week prior to the next date.
