An application under Order XXVI Rule 9 CPC filed on
behalf of plaintiff on 22/09/2026 and another applicaiton under
Order VII Rule 11 CPC, alongwith copy of judgments has been filed
on behalf of defendant no. 1 on 01/07/2026. Copies be exchanged.
Ld. counsel for the defendant no. 2 submits that the
appeal preferred by the plaintiff agaist the order of dismissal of the
application under Order XXXIX Rule 1 & 2 CPC was dismissed by
the Hon’ble High Court of Delhi and he further submits that he
supports the applicaiotn filed on behalf of defendant no. 1 under
Order VII Rule 11 CPC.
Reply, if any, to the said applications be filed within
three weeks with copy to opposite side. Rejoinder thereto, if any, be
also filed within two weeks from receipt of copy with copy to
opposite side.
