Ld. Counsel for plaintiff has moved an application
bearing no. IA/01/2026 under Order XI Rule 1(5) r/w Section
151 CPC for seeking leave to rely on additional documents.
Another application bearing no. IA/02/2026 under Order XI
Rule 1(4) Commercial Courts, Commercial Division and
Commercial Appellate Division of High Courts Act, 2015 r/w
Section 151 CPC alongwith an affidavit under Order 11 CPC
regarding declaration by way of affidavit in compliance with 6
Commercial Courts, Commercial Division and Commercial
Appellate Division of High Courts Act, 2015. Copy be supplied.
One another application bearing no. IA/03/2026
under Order XXXVIII Rule 5 (3) r/w Section 151 CPC for
attachment of immovable property of the defendant.
Heard. File perused.
Let summons of the suit be issued upon the
defendant(s) on filing of PF through all permissible modes,
returnable on 10.12.2026.
Summons be sent through speed post by the plaintiff
himself and thereafter he will file the MO/tracking report.

Summons through e-mail to the defendant, be sent
by the plaintiff itself.
Affidavit of proof of service be also filed by the
plaintiff.
Notice of the application bearing no. IA/03/2026
under Order XXXVIII Rule 5 (3) r/w Section 151 CPC for
attachment of immovable property of the defendant be also
issued upon the defendant for NDOH ie. 10.12.2026.
Application bearing no. IA/01/2026 & IA/02/2026
put up for consideration on the date as already fixed.
