JD is absent.
Sh. Kamlesh Kumar, Ld. Counsel for the JD along
with Sh. Prayag Raj/ father of the JD in person.
Today, Ld. Counsel for the JD and the father of the
JD submits that one month more time be granted to the JD for
making the payment.
Record reveals that the present execution is filed in
the year 2024 and subsequently warrants of arrest were also
issued against the JD which were stayed by this court on the
LDOH, on the undertaking of the JD for making the payment.
Today again no payment has been made by the JD
and neither the JD is present in the court.
From the conduct of the JD it is evidently clear that
the JD is willfully delaying the present execution. However, still
in the interest of justice one more opportunity is granted to the JD
for making the payment subject to cost of Rs. 10,000/- to be paid
to the DH on the NDOH.
List the matter for appearance of the JD and for
payment on 15.11.2025.
