plaintiff.
Ms. Chinki Guliya, Ld. Counsel for the defendant
alongwith defendant.
An application for filing the appearance u/o 37 Rule 3 r/w
151 CPC as well as an application seeking condonation of delay in
filing the memo of appearance is filed on behalf of defendant. Ld.
Counsel for the plaintiff opposes the same submitting that on record,
even written statement was filed only on 21.02.2026, so even filing of
the written statement cannot be treated as an appearance filed by
defendant.
Heard.
Record shows that defendant was served with the summons
u/o 37 CPC on 17.01.2026 and during the course of arguments, Ld.
Counsel for the plaintiff admits that written statement was received by
him on 30.01.2026, so delay in filing the appearance is hereby
condoned.
Further, an application for issuance of summons for
judgment had already been filed by the plaintiff. Heard. Let summons
for judgment in the prescribed format u/o 37 CPC be issued to the
defendant at the address filed, on filing of PF(within one week), RC &
Speed post for 23.05.2026. Report obtained from internet in respect of
the service to defendant through Speed Post be placed on record by the
counsel for the plaintiff.
