I have already heard arguments on charge on behalf
of accused Asif and Babli. I have also perused the record.
At this stage, Ld. Counsel for accused Rifat Ali
submits that she wishes to concede the charge.

O R D E R
As per the case of the prosecution, on the basis of
secret information, accused Asif was apprehended with 500
grams of smack which he had allegedly received from one Rifat
Ali @ Danish and Rahil (not arrested) for the purpose of supply
to accused Babli. During investigation, accused Asif had also
named accused Babli to be supplier and receiver of contraband
from them. Accused Asif had also disclosed the mobile number

of accused Rifat Ali and Babli to the police officials. Accused
Rifat Ali @ Danish was also traced through his mobile location
and was apprehended while he was trafficking 300 gram of
smack in the vehicle S-Cross UP-25DL-8462, registered in his
name. Further, during investigaion, accused Babli was also found
connected with co-accused Asif from her mobile number
8506911752 on which she received calls from the mobile number
8954601732 of co-accused Asif. Therefore, I am of the
considered view that there is enough material available on record
to frame charge under section 29 r/w section 21 (c) of NDPS Act
are made out against accused Babli, charge under section
21(c)/25 r/w 29 of NDPS Act are made out against accused Rifat
Ali and charge under section 21(c) r/w 29 of NDPS Act are made
out against accused Asif.
Separate formal charges are framed accordingly, to
which accused persons pleaded not guilty and claim trial.
Put up for PE on 22.07.2024 and 13.08.2024.
Complainant, duty officer, MHC (M) and IO be
summoned for 22.07.2024.
PWs mentioned at serial no. 13, 14, 20, 21 alongwith
MHC (M) and IO be summoned for 13.08.2024.
