Defendant no. 4 is already ex-parte vide order dt.
13.02.2024.
Perusal of record reveals that vide order dt. 02.05.2024,
summons sent to defendant no. 3 was received back unserved. On the
same day, submissions were made by the counsel for the plaintiff to
file appropriate application u/O 5 Rule 20 CPC, however, same has
not been filed till date. In view of the same, last and final opportunity
is granted to the plaintiff take steps qua D-3.
At this stage, Ld. counsel for the defendant no. 1 submits
that vide previous order dt. 23.10.2024, LC has been appointed,
however, the compliance qua the fees and other requirement could not
be done by the defendant no. 1 owing to some personal difficulty on
behalf of counsel for the defendant no. 1.
Ld. Counsel for the defendant no. 1 has sought another
opportunity for compliance of the same. The same is allowed and the
fees and all the formalities be done within 07 working days and Local
Commissioner shall visit the suit property alongwith both the parties /
counsels on 04.12.2024 at 2:00 PM or any other day within 14
working days, as convenient to both the parties as well as Local
Commissioner. Further, the order dt. 23.10.2024 be complied in letter
and spirits.
