Defendants no. 2 to 4 are already ex-parte.
Ld. counsel for the plaintiff has filed evidence by way of
affidavit without list of witnesses. Same is taken on record. Copy
supplied to counsel for the defendant no. 1.
Ld. counsel for the plaintiff submits that apart from
plaintiff no. 1, there is no witness to be examined.
At this stage, Ld. counsel for the plaintiff has submitted
that despite orders of this court, all the defendants are creating hurdles to
the plaintiffs in entering the suit property. Ld. counsel has submitted that
a contempt application in this regard has been moved separately.
Heard.
Perusal of the record reveals that vide order dt. 16.04.2025,
application u/O 39 Rule 1 & 2 CPC was disposed off by this court as
allowed and D-2 to D-4 were restrained from dispossessing the plaintiffs
from the suit property without following due process of law till the final
disposal of this case.
The order dt. 16.04.2025 is clear in itself and needs no
further clarification or elaboration.
At request, copy of this order be given dasti to counsel for
the plaintiff.
