Present: Sh. Aziz Ullah, Ld. Counsel for the plaintiff with
plaintiff.
Sh. Shiv Dutt Kaushik, Ld. Counsel for the
defendants through VC.
Replication filed on behalf of the plaintiff. Copy has
already been supplied to the defendants.
Ld. Counsel for the plaintiff seeks some more time
to file reply to the application of the defendants U/o 7 Rule 11
CPC.
In the interest of justice, time is given.
At this stage, Ld. Counsel for the plaintiff submits
that the defendants are in the process of dispossessing the
plaintiff. He requests that arguments on the application U/o 39
Rule 1 & 2 CPC be heard today.
Ld. Counsel for the defendants however submits that
he is not prepared with the arguments. He further submits that he
needs some time to take instructions from the defendants and to
advance arguments. He seeks adjournment to advance arguments
on the application U/o 39 Rule 1 & 2 CPC stating that the
defendants shall not take any coercive steps against the plaintiff
till the next date of hearing. He has assured the Ld. Counsel for

the plaintiff that the defendants will not dispossess the plaintiff
from the suit property till the next date of hearing.
Considering the submissions made by the Ld.
Counsel for the defendants, Ld. Counsel for the plaintiff does not
oppose the request made by the Ld. Counsel for the defendants
for adjournment. Accordingly, at the request of the Ld. Counsel
for the defendants, adjournment is allowed for today.
Now to come up for arguments on the pending
applications on 18/08/2025.
