Fresh execution petition received by way of assignment. It be checked
and registered as per rules.
Present: Sh. Shivam Sharma, ld. Counsel for the DH.
Ld. Counsel for DH states that he wants to withdraw the
present execution petition in view of the judgment of the Hon’ble Delhi
High Court in the case of “Kotak Mahindra Bank Ltd. vs. Narender
Kumar Prajapat” decided on 17.05.2023 EFA (Comm.) 3/2023, CM Appl.
25636/2023 wherein execution petition for ex-parte arbitral award in
arbitration proceedings conducted by sole arbitrator appointed at the Sole
discretion of DH was held to be not maintainable. He further submits that
in case, the DH is given relief by the Hon’ble Apex court, he may be
permitted to file the execution petition afresh.
Heard. Separate statement of ld. Counsel for DH recorded to
this effect.
In view of the submissions made and separate statement of
ld. Counsel for DH, the present execution petition stands dismissed as
withdrawn with liberty to file afresh.
File be consigned to record room after due compliance.
