Present: Sh. Vishwas Ahuja, Ld. Counsel for the plaintiff.
Fresh site plan has been filed on behalf of plaintiff
on 06/12/2024 reflecting the property of which the possession
has been sought by the plaintiff.
At this stage, it can be observed that an application
U/o 6 Rule 17 CPC along with amended suit and documents had
been moved by the plaintiff on 06/12/2024.
Heard on the aforesaid application.
It is submitted by the Ld. Counsel for the plaintiff
that the plaintiff had inadvertently mentioned “RED” Colour in
the last line of the prayer clause (Para A) of the suit instead of
“BLUE” Colour and had inadvertently not mentioned “Yellow
Colour” in the last line of Para B of prayer clause. He submits
that by way of the amendment sought, the plaintiff intends to
specify the area in yellow in the site plan, of which the
possession has been sought by the plaintiff. Thus, he wants to
amend the plaint accordingly.
Heard. Record perused.
Considering the fact that the suit is at initial stage
and defendants are yet to be summoned in the present matter, the

application U/o 6 Rule 17 CPC moved on behalf of plaintiff is
allowed. Amended plaint is taken on record.
Issue summons of the suit and notice of the
application U/o 39 Rule 1 & 2 CPC to the defendant(s) on filing
of PF/RC returnable by the next date of hearing.
Steps be taken within one week.
