Present: Mr. Viswas Ahuja, Ld. Counsel for the plaintiff
alongwith plaintiff.
Mr. Aashutosh Kumar, Ld. Proxy Counsel for the
defendant no. 1 & 2.
Ms. Reeta Rana, Ld. Counsel for defendant no. 3
through VC.
Ld. Proxy Counsel for defendant no. 1 &2 submits
that defendant no.1 has approached the MCD and written a letter
for appointment of the Structural Engineer, however, no reply has
been received.
It is informed to Ld. Proxy Counsel for defendant no.
1 &2 that MCD does not provide any such Structural Engineer for
private purpose.
List of structural engineer empanelled with MCD is
provided on MCD website.
Ld. Counsel for plaintiff concedes to the same and
states that he has approached one of the empanelled Structure
Engineer who had cited fees of Rs. 60,000/- to 80,000/- for the
said purpose.
It is further submitted by the Ld. Counsel for
plaintiff that defendant no. 1 &2 are deliberately lingering on the
matter and not concluded the cross-examination of PW1.

It is further submitted that matter be proceeded
further as defendant no. 1 &2 are apparently not interested in
appointment of any Structural Engineer.
At this stage, Ld. Proxy Counsel for defendant no. 1
&2 submits that defendant no. 1 & 2 shall not further cross-
examine PW1 and he may be discharged.
Separate statement of Ld. Proxy Counsel for
defendant no. 1 &2 recorded to this effect.
Ld. Counsel for defendant no.3 has not cross-
examined PW1 despite opportunity.
In view of the above, PW1 stands discharged.
Put up for further PE on 07.08.2026.
Advance affidavit be filed with copy to opposite side.
