with proposed LR of the deceased plaintiff.

An application U/o 22 rule 3 CPC along with copy
of death certificate of original petitioner, Vakalatnama and copy
of resolution filed on behalf of plaintiff. It is submitted that the
petitioner Society has earlier filed the present case through its
president Sh.Yashvant Singh Gautam who has expired on
24.01.2026 and now the Society has resolved to appoint
Ms.Kailashwati Gautam as its AR vide resolution dated
14.02.2026. Copy supplied.
The application is apparently filed under wrong
provision of law. The correct application should have been for
substitution of the AR upon the death of the original AR.
However, in the interest of justice, present
application shall be read as application under section 151 CPC
for aforesaid purpose.
The president of the petitioner Society is directed to
appear in person on the next date of hearing along with the
original resolution passed in favour of Ms.Kailashwati Gautam.
Reply, if any, to the application be also filed before
NDOH with advance copy to the opposite party.
