It is jointly submitted by the parties that the order
dated 20.05.2024 has been complied with and the transferred
amount of Rs.1,29,807/- has been separated from the current bills
pertaining to the electricity connection of the plaintiff at CA no.
150006297.
Matter is listed today for admission-denial of
documents, if any / framing of issues.
It is submitted on behalf of the parties that there is
no document for admission and denial.
On the basis of pleadings of the parties, following
issues are framed for adjudication:-
Issue No.1:Whether the suit has been properly
valued for the purposes of court fees? OPD.
Issue No.2:Whether the dues in the sum of
Rs.1,94,000/- vide CA No. 150006297 have been
wrongly claimed by the defendant from the
plaintiff? OPP.
Issue No.3:Whether the plaintiff is entitled to a
decree of declaration as prayed in prayer clause (a)?
OPP.
Issue No. 4:Whether the the plaintiff is entitled to a

decree of mandatory injunction as prayed in prayer
clause (b) ? OPP.
Issue No.5:Whether the plaintiff is entitled to
permanent injunction restraining the defendant from
disconnecting the electricity meter bearing CA No.
150006297? OPP.
Issue No.6:Relief?
No other issue arises or is pressed for.
Both the parties are directed to file their respective
list of witnesses in terms of order XVI rule 1 CPC within 15 days
from the date of order. The plaintiff is directed to file affidavits
of all the PWs before the next date of hearing with advance copy
to the defendant(s) at least one week before the next date of
hearing.
