unserved with report that suit property is under construction and
found lock.
Status report filed by D-2/MCD, copy supplied.
Report filed by D-3/SHO, PS Gokalpuri. It is
mentioned in the report that the matter pertains to jurisdiction of
PS Bhajanpura.
It is submitted on behalf of plaintiff that the MCD
has filed completely false report. The defendant no. 1 is not
raising construction in consonance to BBL, 2016 and also in
consonance to sanction construction plan as there are visible
projection over municipal land which can be seen into
photographs filed by plaintiff and as per BBL, 2016, projection
on municipal land is unauthorised construction.
The copy of photographs filed by plaintiff and the
copy of status report filed by JE&AE/MCD/D-2 be sent to DC

concern to file fresh status report under his signature on next date
of hearing.
AE & JE, who filed the present status report, shall
appear in person on next date of hearing.
Issue fresh summons to D-1/Devender Chopra, on
filing of PF & RC, returnable for next date of hearing.
In case of refusal, the process be served by way of
affixation. Process server is directed to make necessary
compliance regarding service by way of affixation.
It be relisted on 28.10.2026.
