Present: Ld. Counsel Sh. Deepak Shah for the DH.
None for the JD.
Warrants of attachment issued against the JD in
terms of previous order have been received back unexecuted.
Ld. Counsel for the DH states that the JD has made a
payment of Rs. 6,000/- only till date. He states that the JD is
deliberately delaying the execution petition. He further submits
that the family members of the JD started misbehaving with the
Bailiff and created obstruction in the execution of the warrants of
attachment.
Report on the warrants of attachment also reveals
that the family members of the JD created nuisance and
obstruction in the execution of the warrants of attachment.
At request of Ld. Counsel for the Decree Holder, let
fresh warrants of attachment of movable properties of the JD be
issued on filing of PF returnable for the next date of hearing.
Steps be taken within a week.
SHO concerned is directed to provide police aid to
the DH and Bailiff for proper execution of warrants.
DH is directed to appear before the Ld. ACJ (NE),
Karkardooma Courts, Delhi, on 03/11/2025 for appointment of
Bailiff.
Now to come up before this court on 04/12/2025.
