Present: Sh.Alok Ld. Counsel for the applicant.
An application U/s 151 CPC is filed on behalf of the
Petitioner for restoration of the Succession Petition. Ld. Counsel
for the Petitioner submits that petitioner is a poor and widow lady
and inadvertently steps could not be taken for issuance of notice
to the respondents. He prays for restoration of the petition.
Heard. Record perused.
After hearing the submissions of Ld. Counsel and
going through the case file, the succession petition be restored to
its original number and stage subject to payment of cost of Rs.
2000/ to be deposited in DLSA/NE. Cost paid by Ld. Counsel
through Emode. Receipt produced.
Issue notice to respondent no. 2 & 3 on filing of PF
returnable for 28.02.2024.
