Order Details: COPY OF ORDER Pdf Text: 21 MISC SCJ 77/25 SANTOSH SHARMA Vs. BSES YPL 21.11.2025 Present: Sh.B.N. Singh, Ld. counsel for petitioner. Sh. Prashant Kumar Sharma, Ld. counsel for respondent/BSES alongwith Deputy General Manager/Sh. Devender Panwar. Respondent placed on record copy of bill dated 13.05.2025 in the name of petitioner Ms. Santosh, whereupon the endorsement regarding part payment has been made by the official of respondent. Same is retained on record. Written synopsis also filed by respondent, taken on record. Arguments advanced on behalf of both sides. It is fairly conceded on behalf of contemnor that it is Sh. Dinesh Chand, who deposited the amount of Rs. 25,200/- against the current demand of Rs. 3,645/- for the bill reflecting the arrears which sum totals amount of Rs. 75,250/-. It is further submitted that after the bill dated 13.05.2025, the respondent is fairly receiving only current demand and not the arrears. It is further submitted that after getting the notice of this fact of contention raised by consumer/Ms. Santosh that she don’t want to deposit the arrears, so respondent/BSES will credit the excess amount in the CA number of petitioner. It is specified that the current demand amount will be deducted from Rs. 25,200/- which was deposited against the bill dated 13.05.2025 and -- 1 of 2 -- remaining will be credited in the account of CA number pertaining to petitioner Ms. Santosh. In view of the submissions on behalf of respondent, it is reflected that the respondent has fairly conceded to credit the excess amount in the account pertaining to CA number of petitioner Ms. Santosh, so for the allegation against the respondent that the petitioner was forced to pay excess bill needs the evidence. Matter is adjourned for framing of issues. It be relisted alongwith connected case on 16.02.2026. AJAY KUMAR MALIK JSCC/ASCJ/G.JUDGE (N/E) 21.11.2025 -- 2 of 2 --
