An application u/O VIII Rule 1 read with section 151 CPC and section 5
of the Limitation Act seeking permission to place on record WS after the period of 30
days from the date of service of summons is pending disposal. No reply to the
application is made by the plaintiff. The Plaintiff submitted that the application be
allowed but only subject to payment of cost by the defendant to the plaintiff.
Case file perused. Considering the fact that another litigation between
the parties was pending before CGRF and also the fact that the defendant is a
corporate entity who cannot be expected to deliberate and take decisions with
swiftness of a natural person, the delay of 5 days in filing the WS is condoned to the
effect that the WS of defendant is taken on record.
No cost is being imposed upon the defendant. List the matter for filing
of replication, if any, for admission/denial of documents as well as for framing of
issues on 28.02.2024.
