Pur Extension, Delhi-110094, according to property documents

Extension, Delhi-110094 came to the share of plaintiff through
an oral family settlement in the year 2007 at his native village

of Specific Relief Act, 1963. It is further stated that the suit is bad
for misjoinder of necessary party. It is further stated that neither
the suit has been properly valued nor appropriate court fee been
affixed as per law. It is further stated that present suit is liable to
be dismissed u/o VII Rule 11 CPC.
4. I have given my thoughtful consideration on the
submissions made on behalf of the parties.
5. Perusal of record shows that the plaintiff has placed on
record the electricity meter bearing CA No. 101435506 in her
name with date of energisation as 22.06.2005, which show that
the plaintiff was in exclusive possession of such property, where
as on the other hand, the defendant fails to show any ownership
document in their name or the proof of exclusive actual physical
possession of such property with them at any point of time.
Plaintiff has also placed on record certain documents to show her
ownership over suit property. So, there is prima-facie case in
favour of plaintiff. Since the present suit pertains to immovable
property, the plaintiff is likely to suffer irreparable loss and injury

which cannot be compensated in terms of money. Accordingly
balance of convenience also tilts in favour of plaintiff.
6. For discussion above-stated, the present application of the
plaintiff under Order 39 Rules 1 & 2 CPC is allowed to the extent
that the defendants are hereby restrained from creating any third
party interest in property bearing H. No. 94, Gali No. 4, Sadatpur
Extension North-East, Delhi-110094 measuring area 50 sq. yds
till the disposal of the suit. Nothing stated herein above shall
tantamount to be my expression on merits of the case.

documents and framing of issues.
