From the pleadings of the parties and the material
on record, the following issues are framed in the present suit:-
1. Whether the plaintiff is entitled to decree of possession of
suit property, as prayed for ? OPP
2. Whether the plaintiff is entitled to decree of damages and
for arrears of rent, as prayed for ? OPP
3. Whether plaintiff is entitled of pendente-lite and future
damages? OPP
4. Whether the suit has been improperly valued? OPD
5. Whether the suit is maintainable in the present form ? OPD
6. Relief.
In view of the objections of defendant that proceedings in
the instant matter is barred by SARFAESI Act, let the following
preliminary issue be framed.
1. Whether the jurisdiction of this court is barred by
SARFAESI Act? OPD
No other issue arises or pressed for.
An application under Order XXXIX Rule 1 and 2
CPC is also pending disposal and same shall be disposed after
deciding the preliminary issue.
