Taken on record. Counsel for defendant further submits that he is
filing the documents in compliance of order dated 19.08.2025
physically. Copy be supplied to the opposite side.
Ahlmad is directed to verify the said documents
whether the same are in consonance with the documents filed
through e-filing, as mentioned in the last order-sheet.
At this stage, Ld. Counsel for the defendant submits
that he shall withdraw the application under Section 9 of CPC moved
by previous Counsel for the defendant, as the same is not
maintainable for the purpose of the prayer with respect to rejection of
plaint. It is further submitted by Ld. Counsel for the defendant that he
shall file a fresh application under appropriate provisions of law.
Heard.
Statement of Ld. Counsel for defendant is taken on the
application itself. In view of the same, the application under Order 9
of CPC stands dismissed as withdrawn.
