applications.
Ld. Counsel for the defendant states that the present
suit is not maintainable as the jurisdiction of civil court is barred
U/s 70 of the Delhi Cooperative Societies Act. He states that the
plaintiff is a Member of the defendant Cooperative Society and
thus the dispute between the plaintiff and the defendant Society
shall be referred to the Registrar for decision and this court has
no jurisdiction to entertain the present suit.
Ld. Counsel for the plaintiff states that the plaintiff
is not a Member of the Cooperative Society and thus Section 70
of the Delhi Cooperative Societies Act is not applicable to him.
At this stage, Ld Counsel for the defendant states
that the submissions made on behalf of the plaintiff are incorrect
and seeks some time stating that he intends to place on record the
membership documents of the plaintiff.
Ld. Counsel for the plaintiff also seeks adjournment
stating that he intends to file relevant case laws.
At request, now to come up for further
arguments/further proceedings on 09/09/2025.
