Order Details: COPY OF JUDICIAL PROCEEDINGS
Pdf Text: 14 Civ Suit 387/26
PINKI JAIN Vs. JAI KAUSHIK
11.08.2026
Fresh case received by way of e-filing. It be checked and
registered as per rules.
Present: Sh. A.K Dubey, Ld. Counsel for the plaintiff
alongwith plaintiff.
Ld. Counsel for the plaintiff seeks ex-parte ad
interim injunction against the defendants restraining them from
dispossessing the plaintiff without due process of law.
Ld. Counsel for the plaintiff submits that they are
the tenant in the suit property and the defendants are trying to
dispossess them on the basis of their claim that they had
purchased the suit property from previous owner.
Ld. Counsel for the plaintiff relies upon
photographs, copy of complaints & receipts, copy of Aadhar
Card & Voter ID Card, Copy of Bank Passbook and Newspaper
to show their possession in the suit property. Ld counsel also
relies upon the judgment of Hon’ble High Court of Delhi in DDA
Vs. Shish Pal.
I have heard the counsel for the plaintiff and perused
the record. It is a settled law that even a trespasser is entitled to
protect his possession against forcible dispossession. Even a
trespasser is entitled protection of law from being unlawfully and
forcefully dispossessed from the property under his possession.

In the present matter the documents relied upon by the plaintiff
prima facie show their possession over the suit property and their
eviction without due process of law will entail irreparable losses
to them. Thus, in my view it is imperative in the current
circumstances to grant the relief of ex-parte ad interim
injunction.
Accordingly, the defendants are restrained from
dispossessing the plaintiff without due process of law till NDOH.
Issue summons to the defendant for settlement of
issues through all modes, on filing of PF/RC, returnable for
25.08.2026.
Copy of this order be given dasti.
Steps to be taken within 07 days.
