Present: Sh. Devender, Ld. Counsel for the plaintiff.
An application U/o 6 Rule 17 CPC along with
amended plaint has been filed by the Ld. Counsel for the
plaintiff.
Heard on the aforesaid application.
It is submitted by the Ld. Counsel for the plaintiff
that in the original plaint, the prayer clause is incomplete and the
relief of declaration qua ownership of the plaintiff could not be
mentioned due to an inadvertent error. It is further submitted that
plaintiff intends to amend the plaint and substitute prayer clause
(a) by way of present application.
Heard. Record perused.
Considering the fact that the suit is at initial stage
and defendants are yet to be summoned in the present matter,
further that the amendment sought is only for rectification of a
clerical error, the application U/o 6 Rule 17 CPC moved on
behalf of plaintiff is allowed. Amended plaint is taken on record.
Issue summons of the suit and notice of the
application U/o 39 Rule 1 & 2 CPC to the defendant(s) on filing
of PF/RC returnable by the next date of hearing.
Steps be taken within one week.
Now to come up on 30/01/2025.
