Order Details: COPY OF ORDER Pdf Text: Civ Suit 249/23 Alimuddin Gahlot Vs. Mohd Yameen 29.05.2023 Fresh civil suit received by way of assignment. It be checked and registered as per rules. Present: Ld. Counsel for plaintiff. It is the case of the plaintiff that he is owner and in possession of property No. B-532, Gali No. 4, Subhash Mohalla, North Ghonda, Delhi-53 by virtue of GPA dated 12.05.2005 executed by defendant. It is stated that as per the GPA, the plaintiff was granted possession of the property accessible via common entrance from the main gate. Plaintiff has filed copy of invoices, receipts and copy of GST certificate, to show that he is running business from the suit property. It is alleged by the plaintiff that the defendant who is in possession of adjacent house has locked the common entrance and police complaint in this regard have also been filed and at present plaintiff is using back entrance of the property. The present suit has been filed against the defendant seeking mandatory injunction by directing the defendant to open the lock of the common passage and for decree of permanent injunction against the defendant directing him to keep the common passage open in future. Submissions heard. Record perused. Summons be issued to the defendant through all modes on filing of PF/RC for 25.07.2023.
