It is submitted by Ld. counsel for plaintiff that the plaintiff has preferred the petition before Hon'ble High Court of Delhi against the order passed by Ld. District & Sessions Judge, KKD and the orders passed by Ld. District & Sessions Judge has already been stayed. It is further submitted that Ld. Appellate Court passed certain directions for this Trial Court to take steps for restoration of status quo ante and there was time for challenging the orders passed by Ld. Appellate Court but in contravention to spirit of orders passed by Ld. Appellate Court, the defendant themselves demolish the structure which also includes the office of plaintiff, which was admittedly there in the admitted site plan relied upon by defendant and this version is well supported by report filed by SHO, PS Karawal Nagar.
