WS filed by D-1 & D-2 alongwith reply to
application u/o 39 Rule 1 & 2 CPC and also filed application u/o
8 Rule 1 CPC for condonation of delay in filing the written
statement. Copy supplied.
On no objection given by Ld. counsel for plaintiff,
the application u/o 8 Rule 1 CPC is allowed. WS taken on record.
It is submitted by Ld. counsel for defendant that they
are waiting for some development in their office, which will give
proper guidance to the action of defendants as the defendant is
still under process of scrutinising the reply to show cause notice
to plaintiff and same shall be done within very short span of time.
It is further submitted that the defendants undertake not to
execute any action in pursuance to their project like removing of
any material from proposed road with regard to suit property till
next Saturday and the disposal of application u/o 39 Rule 1 & 2

CPC may be adjourned till next Saturday, so, the counsel for
defendant may come and argue physically on the matter.
In view of submissions made by Ld. counsel for
defendant, matter is adjourned for 25.07.2026 at 12:30 PM.
It is pointed by Ld. counsel for plaintiff that
D-3/SDM Karawal Nagar is not responding in the present matter,
so, response may be sought from Higher Authorities.
Perusal of record shows that matter was taken up on
05.06.2026, 06.06.2026, 14.07.2026 but till date, there is no
response from D-3/SDM Karawal Nagar.
Copy of ordersheet be sent to Finance Commissioner
for proper response in present matter.
Interim order dated 06.06.2026 to continue till next
date of hearing.
