Process qua defendant no. 4 and 5 received back
served.
Process qua defendant no. 2 received back unserved.
Paper book supplied to defendant no. 1 from court
file.
Issue fresh summons to defendant no. 2/Daljeet
Singh on filing of PF/RC. In case of refusal for acceptance of
process, the process be served by way of affixation. Process
server is directed to take proper photographs and follow other
guidelines in this regard. The plaintiff is at liberty to accompany
the process server for identification of address and addressee.
It is submitted by ld. counsel for defendant no. 1 that
the plaintiff is not having the proper documents in their favour.
In view of submissions from both sides, both the
parties to file their original documents on or before NDOH.
It is submitted by ld. counsel for plaintiff that the
defendant no. 1 present in the court may be restrained from
dispossessing the plaintiff from suit property. Per contra, it is
submitted by ld. counsel for defendant no. 1 that defendant no. 1/

Shishu Pal has already sold out the suit property in about 1994
so, no question arises for defendant no. 1 to dispossess the
plaintiff from suit property. In view of unqualified
statement/admission from defendant no. 1, there is no further
need of any orders in favour of plaintiff.
Ld. counsel for defendant no. 1 got recorded his
separate statement.
Matter is adjourned for filing of WS by defendant
no. 1, 3, 4 and 5 and service to defendant no. 2 on filing of PF.
At convenience of both sides, be re-listed on
05.07.2025.
