Arguments on application under Order 7 Rule 14 r/w
Section 151 CPC have been heard on behalf of both the parties.
Record has been perused.
By way of the application, the plaintiff wishes to
place on record the PNB passbook and the DTC ID Card of the
defendant on record.
In the humble opinion of this court, the documents
are necessary for the fair and just adjudication of the matter.
Moreover, it does not appear that the failure to file the
documents alongwith the plaint was intentional or deliberate.
In view of the aforesaid reasons, the application is
allowed and the aforesaid two documents are taken on record.
Ld. counsel for the plaintiff submits that he wishes
to file a fresh evidence by way of affidavit of PW1 in view of the
application being allowed today. He is directed to supply
advance copy of the evidence by way of affidavit to the
defendant before the NDOH.
Be put up for PE on 02.06.2025.
