does not want to pursue the suit as matter has been amicably settled
between the parties before the Delhi Mediation Centre vide Mediation
No. L-4352/2023 dated 10.07.2023/Ex P1, Delhi. Let his statement to
this effect be recorded. Statement recorded.
Since the subject matter of the suit has been settled between
the parties to their mutual satisfaction, the plaintiff is permitted to
withdraw the suit. The suit of the plaintiff is, accordingly, dismissed as
settled before the Delhi Medaition Centre.
Pending misc., application, if any, also stands dismissed.

damages and permanent injunction received by way of assignment. It

Issue summons for settlement of issues along with notice of
the application u/o XXXIX Rule 1 and 2 CPC to the defendant on filing
of PF/RC, returnable on 05.06.2023.
The Process Server shall make an endevour to serve a copy
of the process by tendering or delivering it to the party personally i.e.
defendant herein. He shall also make all proper efforts to find the party
with a view to effect personal service and if it is not possible after
reasonable endeavour to find the party then only the service may be made
on an adult male member of the family residing with the defendant. In
case of refusal and avoidance of service, the concerned process server
shall also make an endevor to get the service effected by way of affixation
as well.
Steps be taken within 7 days from today.
