Present: Both the plaintiffs in person.
Sh. Nitesh Chaurasia, Ld. LAC for the plaintiffs
through VC.
Defendant in person.
Ld. LAC for the plaintiffs submitted that he has
already filed the appointment letter for the plaintiff no.1 on
record and he shall file the appointment letter for the plaintiff
no.2 before the NDOH.
Written Statement along with documents has been
filed by the defendant. Copy supplied to the plaintiffs today in
the Court. Replication, if any, be filed on or before the NDOH
with advance copy to the other side.
Reply to the application under Order 39 Rule 1 and
2 CPC of the plaintiff has not been filed by the defendant.
It is submitted by the defendant that she will not
create any third party interest in the suit property till the disposal
of the present suit. Statement of the defendant has been recorded
separately in this regard.
Ld. Counsel for the plaintiffs submitted that the
application of the plaintiffs under Order 39 Rule 1 and 2 CPC be
disposed of in view of the above statement.

In view of statement made by the defendant and
submission of Ld. Counsel for the plaintiffs, the application
under Order 39 Rule 1 and 2 CPC is disposed of. The defendant
is directed not to create any third party interest in the suit
property i.e. Second Floor of H.No.F-338, Gali No.6, Near Shiv
Mandir, West Karawal Nagar, Delhi-94 till the disposal of the
present suit.
Application of the plaintiffs under Order 39 Rule 1
and 2 CPC accordingly stands disposed of.
Both the parties are directed to file affidavits qua
Admission/Denial of documents with advance copy to each other.
Re-list for Admission/Denial of documents and
framing of issues on 19.09.2024.
