Order Details: COPY OF ORDER Pdf Text: CS No. 176/23 SATYAWATI DEVI Vs. POOJA 03.05.2023 Present: Plaintiff in person along with Ld. Counsel Sh. Dilip Anand. File perused. Vide order dated 26.04.2023, the plaintiff was directed to file documents of ownership. However, the plaintiff has not filed documents of ownership. It is submitted by Ld. Counsel for the plaintiff that the plaintiff has no document of ownership except the receipt No.124996 issued by DDA. It is further submitted by Ld. Counsel that the husband of the plaintiff was in possession of the suit property and after his death the plaintiff being wife came in possession of the suit property and since then she is in absolute possession of the suit property. It is pertinent to mention that the aforesaid receipt is not a document of ownership. It is copy of a receipt of payment of some money in favour of DDA. Ld. Counsel for the plaintiff has prayed to summon the defendant stating that the plaintiff may prove her ownership and possession during course of trial. Considered. Without returning any finding on the above mentioned issue, let the summons of the suit and notice of the application u/O 39 rule 1 and 2 r/w Section 151 of CPC be issued to the defendant on taking steps by the plaintiff, returnable on 31.05.2023.
