None for defendant no. 1 (defence struck off on

Ld. Counsel appearing on behalf of defendant no. 7
submits that vakalatnama shall be filed during the course of the
day.
Further Ld. Counsel for the defendant no. 7 has
moved an application u/O 1 Rule 10 CPC seeking deletion of
their name from the array of parties.
Copy has been supplied to Ld. Counsel for the
plaintiff. Ld. Counsel for the plaintiff submits that DDA has not
been made a party and the same was already deleted from the
array of witness.
Heard.
Perusal of order reveals that vide order dt.
11.09.2025 defendant no. 7 has already been dropped from the
array of parties. Accordingly, the application u/O 1 Rule 10 CPC
is disposed of as not maintainable.
Let vakalatnama of defendant no. 7 be filed during
course of the day.
Further, an application has moved on behalf of the
plaintiff to serve the defendant no. 2 through substituted service
through publication. In view of the fact that report is not being
received with regard to process issued against defendant no. 2.

The instant application is disposed of as allowed. Accordingly
plaintiff is directed to serve the defendant no. 2 by way of
publication in a newspaper with nation wide circulation
particularly in the area where the defendant no. 2 resides.
Perusal of record would further reveal that defence
of defendant no. 1 was already struck off vide order dt.
11.09.2024.
