Vijay Tyagi, Ld. Counsel for MCD (through VC). Ms. Radhika Gupta, Ld. Counsel for the defendant no.1 (through VC). Summons issued to DDA received back with the report that the office of DDA has shifted. At this stage, Ld. Counsel for the plaintiff has submitted that he wishes to drop defendant no. 3,4,5,6 and 7. Ld. Counsel has moved an application u/O 1 Rule 10 CPC for dropping of defendant no. 3,4,5,6 and 7. Considering that the plaintiff is a master of his suit and also the submission that no relief is being sought from defendant no. 3 to 7. A separate statement of the Ld. Counsel for the plaintiffs is recorded to this effect and the defendant no. 3,4,5,6 and 7 are dropped. Amended memo of parties taken on record. At this stage, Ld. Counsel for the defendant no. 1 has submitted that application u/O VII Rule 11 of CPC is pending. At this stage, Ld. Counsel for the plaintiff has submitted that his application u/O VI Rule 17 of CPC and application u/O 11 Rule 14 CPC was filed before the application Contd… -- 1 of 2 -- -2- u/O VII Rule 11 of CPC of the defendant and is pending adjudication. Ld. Counsel has also submitted that till date no reply has been filed on behalf of the defendant no. 1 qua application u/O 11 Rule 14 CPC. Heard. Defendant no. 1 is directed to file the reply qua both the applications by the NDOH. Further perusal of record reveals that summons to defendant no.2 has been received back with the report ‘house sold’. Plaintiff is directed to file fresh address of defendant no. 2 alongwith affidavit by the NDOH. Put up on 13.11.2025.
