Fresh suit received by way of assignment, it be checked and registered
as per rules.
Present: Sh. Yash Gautam, Ld. counsel for plaintiff.
Plaintiff nos. 2, 3, 4 & 5 are present.
It is submitted by Sh. Anis Ahemad that his property
falls adjacent to that of suit property bearing no. J-3/C, Gali No. 11,
Ward No. 228, Brahmpuri, Delhi-53.
Plaintiff nos. 1-4 failed to show that their property lying
adjacently touching to the suit property. Plaintiff nos. 1-4 also failed to
show the sanction construction plan for their properties, whereas, Sh.
Naeem submitted that he is running the Sanitary shop in his residential
premises, whereas, plaintiff Sh. Pradeep Kumar Goel submits that
earlier he was doing chemical business.
DC concerned is directed to get inspected the properties
of plaintiff nos. 1-4 and file the report on next date of hearing.
Issue summons to defendants and notice on application
u/o 39 Rule 1 & 2 CPC, on filing of PF & RC, for next date of
hearing.
Copy of today's ordersheet alongwith memo of parties
be sent to DC concerned so that proper report may be filed on time.
Matter be relisted on 23.04.2026.
