Replication not filed. On the basis of pleadings of
the parties, following issues are framed for adjudication:-
1. Whether the plaintiff is entitled for a
decree of possession of suit property,
as prayed for? OPP.
2. Whether the plaintiff is entitled for a
decree of permanent injunction, as
prayed for? OPP.
3. Whether the plaintiff is entitled for a
decree of mesne profit and damages,
as prayed for? OPP.
4. Whether the plaintiff has not paid
proper court fees u/s 7 of Court Fees
Act as plaintiff is not in possession of
suit property? OPD.
5. Whether the plaintiff do not have
cause of action to file the present suit
against defendant as defendant are not
tenants of plaintiff? OPD.

No other issue arises or is pressed for.
Both the parties are directed to file their respective
list of witnesses in terms of order XVI rule 1 CPC within 15 days
from the date of order. The plaintiff is directed to file affidavits
of all the PWs before the next date of hearing with advance copy
to the defendant(s) at least one week before the next date of
hearing.
