Present: Sh. Avinash, learned counsel for the plaintiff
None for the defendant despite repeated calls since morning.
This is a suit under Order 37 CPC.
As per the the report of the Ahlmad, the defendant was
served on 15.04.2023, however, she has not entered the appearance within
the stipulated period.
Heard. File perused.
Vide separate judgment of even date, suit of the plaintiff is
decreed under Order XXXVII Rule 2 Sub Rule 3 CPC with interest @ 6
% p.a. from the date of filing of the suit till realization.
Costs of the suit is also awarded to the plaintiff.
Decree sheet be drawn accordingly on filing of deficient
court fees, if any.
File be consigned to record room after due compliance.

received by way of assignment. It be checked and registered as per
rules.

Issue summons of the suit to the defendant in prescribed
form, on filing of PF/RC.
The Process Server shall make an endeavor to serve a copy
of the process by tendering or delivering it to the party personally i.e.
defendant herein. He shall also make all proper efforts to find the party
with a view to effect personal service and if it is not possible after
reasonable endeavor to find the party then only the service may be made
on an adult male member of the family residing with the defendant. In
case of refusal and avoidance of service, the concerned process server
shall also make an endeavor to get the service effected by way of
affixation as well.
Now to come up on 27.04.2023.
Steps be taken within seven days from today.
