alongwith plaintiff.
Sh. Sachin Kumar Shukla, Ld. Counsel for
defendant.
An application under Order 18 Rule 17 CPC has
been filed on behalf of the plaintiff. Taken on record. Copy
supplied.
Arguments have been heard on behalf of both the
parties on the application. Record has been perused.
By way of the application, the plaintiff wishes to re-
open plaintiff evidence and examine the Notary public who
attested the notary agreement between the plaintiff and the
defendant. Further, ld. counsel for the plaintiff submits that she
also wishes to call the record pertaining to the entry in the
register from the Notary Public and that she would file an
appropriate application mentioning the details of the record to be
called.
In the considered opinion of this court, the
examination of the notary public would aid in the fair and proper
adjudication of the case. Further, allowing the application would
not prejudice the defendant or cause any undue hardship to him.
Therefore, the application is allowed subject to a cost of Rs.250/-
to be paid by the plaintiff to the defendant to compensate for the
delay caused. Cost paid.
Ld. counsel for the plaintiff is directed to file the
application mentioning the details of the record to be called from

the witness within two days from today.
Let summons be issued to the witness/ Notary Public
on filing of PF and filing of the details of the record, returnable
for next date of hearing.
Be put up for PE on 27.03.2025.
Date is given at the convenience of both the parties.
