Joint Written Statement filed on behalf of the defendants
is put up with file.
Ld. Counsel for the plaintiff has apprised the court that
copy of Written Statement has been supplied to the plaintiff through
electronic mode.
The Written Statement was filed on 03.07.2023.
However, the summon was served upon the defendants on
05.04.2023. Apparently, the Written Statement has not been filed
within the statutory period.
Ld. Counsel for defendants has orally prayed to condone
the delay in filing the Written Statement.
Ld. Counsel for the plaintiff has not opposed the
submissions on behalf of the defendants.
In the interest of justice, the delay in filing Written
Statement is condoned subject to cost of Rs.1000/- each payable by
the defendants. Out of total cost of Rs.2000/-, Rs.1000/- shall be paid
to the plaintiff and remaining Rs.1000/- shall be deposited in DLSA,
North-East, KKD Courts, Delhi.
Replication, if any be filed by the plaintiff with advance
copy to the defendants.
List for completion of pleadings / admission-denial of
documents, if any / framing of issues on 28.08.2023.
