Order Details: COPY OF ORDER Pdf Text: 15 Civ Suit 113/26 SHIVAM DUBEY Vs. SARITA 24.04.2026 Present: Ms. Sunita, Ld. Counsel for the plaintiff. Application under Order 1 Rule 10 of CPC filed on behalf of plaintiff on 21.04.2026. It is stated in the application that the plaintiff had given the Suit amount of Rs. 90,000/- to the defendant in front of his mother namely Anjana Devi. Therefore, mother of plaintiff is a necessary party and may be impleaded in the present case. Heard. Perused. This is no ground for impleadment of mother of the plaintiff as necessary party as she can very well be called by the plaintiff in his evidence in order to prove the alleged transaction between the parties. The application is disposed off as dismissed Application under Order 6 Rule 17 of CPC has been filed on behalf of the plaintiff along with the amended plaint today. By way of this application, plaintiff seeks to bring on record that the transaction in question that was entered between the parties in the presence of the mother of the plaintiff. Heard. Perused. Matter is at a very initial stage. The proposed amendment shall not change the nature of the Suit and accordingly, the application under Order 6 Rule 17 of CPC is allowed and disposed off.
