It is submitted on behalf of DH no. 3 that DH no. 3 has not
entered into any settlement with JD and DH nos. 1 & 2, who are playing
foul in contrary to interest of DH no. 3. It is further submitted that even
on 21.08.2026, Sh. Md. Ikram, Ld. counsel for DH nos. 1 & 2 appeared
even without any notice of application from court and gave no objection
regarding stay of warrant of attachment/possession.
Warrants of possession already got executed vide order
dated 19.09.2025.
It is submitted by Ld. counsel for DH nos. 1 & 2 that the
matter already got settled between the parties for amount of Rs.
30,00,000/- as rent, out of which, JD has already paid Rs. 18,00,000/-. It
is further submitted that the JD has undertaken to pay the remaining
amount within 45 days from today and appeal is pending with next date
of hearing 30.09.2026.
Ld. counsel for JD concede to submissions made by Ld.
counsel for DH nos. 1 & 2.
Matter be relisted on 30.10.2026.
