None has appeared for DH despite repeated calls since morning. Neither
the receipt of previous cost of Rs. 5000/- has been filed. In the interest of justice,
appearance of DH be awaited till 2.00 pm.

None has appeared for the DH despite repeated calls, since morning.
Perusal of the previous order sheets reveals that DH has not been
appearing for the last two dates of hearing. Record further reveals that vide order
01.12.2023, DH was given last opportunity for appearance and for pursuance of the
instant execution petition subject to cost of Rs. 5000/-. However, receipt of cost has
yet not been filed. None has joined the Court proceedings today on behalf of DH
despite repeated calls, since morning. The approach of the DH is very lackadaisical. It
appears that DH is not interested in pursuing the present execution petition. Matter
cannot be kept pending for indefinite period. Hence, the instant execution petition is
dismissed in default for non-appearance and non-prosecution. Pending application, if
any also stands dismissed for non-prosecution.
File be consigned to Record Room after due compliance.
