Order Details: COPY OF ORDER Pdf Text: 5 Civ Suit 99/26 CNR No. DLNE03-000159-2026 MOHD TAUSEEF KHAN Vs. RUBY 23.09.2026 Present: Sh. S.N. Khan, Ld. counsel for plaintiff alongwith PW/Mohd. Touseef Khan. Sh. Sandeep Kumar, Ld. counsel for defendant alongwith Sh. Mehruddin, husband of defendant. Defendant already proceeded exparte vide order dated 13.07.2026. Evidence by way of affidavit filed, copy supplied. PW-1/Mohd. Touseef Khan examined and discharged. It is submitted by Ld. counsel for defendant that, as per instructions received from defendnat, the defendant undertake not to create any third party interest in the suit property i.e. L-Side flat situated at third floor comprising three rooms set, latrine bathroom and kitchen part of property no. C-43, Third Floor, Gali No. 7, Brahampuri, Main Road, Delhi-110053 and defendant has no objection if the application u/o 39 Rule 1 & 2 CPC is allowed. Separate statement of Ld. counsel for defendant is recorded to this effect. In view of above, the application u/o 39 Rule 1 & 2 CPC filed by plaintiff is hereby allowed and defendant is hereby -- 1 of 2 -- restrained from creating any third party interest in the suit property i.e. L-Side flat situated at third floor comprising three rooms set, latrine bathroom and kitchen part of property no. C-43, Third Floor, Gali No. 7, Brahampuri, Main Road, Delhi-110053 till final disposal of suit. At joint request from both parties, the matter is referred to Mediation Cell, Karkardooma Courts, Delhi, on 01.10.2026 at 02:00 PM to enable the parties to pursue settlement talks. Parties are directed to appear in person alongwith their counsels before the Mediation Cell, on the above said date and time. Ahlmad is directed to send the reference well in advance.
