Vide statement recorded separately at bar, Ld. Counsel for the DH
submitted that the entire payment as per Mediation Settlement is made by the JDs.
He prayed that the execution petition be disposed of as settled/satisfied in terms of
Mediation Settlement dated 14.09.2023. The Execution Petition is disposed of as
satisfied/settled as per Mediation Settlement. All pending applications are also
disposed of.
Ld. Counsel for the JDs pointed out that as per point no. 6 iii of the
terms of mediation settlement, the DH has to return deposit amount of Rs.23,700/-
alongwith interest as per Society Rules to JD No. 1 within 15 days after receiving the
entire settled amount. He also stated that NOC to all the JDs is also to be issued by
DH after 15 days of receiving the entire settled amount. He prayed that the matter be
kept pending so that the DH complies with the aforementioned terms of the
mediation settlement. The request is acceded to.
