None for defendant no. 4/MCD.
Ld. counsel for defendant seeks adjournment with
submission that due to some pre-occupied matter at his house he
needs to go to home today and will not cross-examine the
witness.
Oral submissons made by Ld. counsel for plaintiff
that due to some personal contigency he could not appeared on
22.01.2026, so, cost imposed vide order dated 22.01.2026 may be
reduced. In view of submissions made by Ld. counsel for
plaitniff the cost of Rs. 5000 imposed vide order dated
22.01.2026 is reduced to Rs. 2000. Rs. 500 each is paid to
defendant no. 1, 2 and 3 and Rs. 500 will be paid to defendant
no. 4 on next date of hearing.
It is submitted on behalf of defendant no. 1-3 that
vide order dated 16.09.2025 the cost of Rs. 5000 was imposed on
plaintff which was to be paid equally to defendant no. 1-4,
whereas, vide order dated 22.01.2026, Ld. counsel for defendant
no. 1-3 has received the entire cost and he undertakes to pay the

proportionate quantum of cost to defendant no. 4 within three
days from today.
Matter is adjourned for PE.
It be relisted on 06.06.2026.
