Counsel for all the defendants.
Defendant no. 3 submits that he shall not be creating any
third party interest in the suit property till the final disposal of the present
suit. Separate statement of defendant no. 3 is recorded in this regard.
Perusal of the record reveals that statement of defendants no.
1, 2 & 4 already on record.
In view of the same, application u/O 39 Rule 1 & 2 CPC
stands disposed off as allowed and the defendants are restrained from
creating any third party interest in the suit property till the final disposal of
the suit.
At this stage, Ld. Counsel for the defendants has submitted
that last and final opportunity was granted to the plaintiff for filing evidence
by way of affidavit. However, the same has not been filed.
Heard.
Perusal of the record reveals that on the last date of hearing
last and final opportunity was granted for filing evidence by way of
affidavit. In the interest of justice, one more opportunity is granted for the
said purpose subject to cost of Rs. 500/- to be deposited in DLSA/NE. Let
this be clear that no further opportunity shall be granted.
