defendants.
Arguments on application U/o 7 Rule 11 CPC heard
on behalf of both the sides.
An application U/o 8 Rule 1 CPC already on record.
Copy supplied. Arguments heard.
There is a delay of 42 days in filing of WS. Ld.
Counsel for the Defendant submits that his associate was
threatened out side the court room for filing his vakalatnama in
the present case. Therefore, WS could not be filed in time.
Per contra, Ld. Counsel for the Plaintiff submits that
no such incident as alleged by Ld. Counsel for the Defendant
ever took place. He further submits that WS be allowed subject
to heavy cost.
Heard. Perused.
Application u/o 8 Rule 1 CPC is allowed subject to
cost of Rs. 1500/- to be paid to the plaintiff. Delay condoned. WS
is taken on record. Copy already supplied.
Application disposed of accordingly.
Replication if any be filed on or before the NDOH
with advance copy to opposite side atleast one week prior to
NDOH.
