Defendant in person with ld. Counsel Sh. Vishnu Sharma.
Ld. Counsel for the defendant submits that he has no
objection, if additional documents filed on behalf of plaintiff are taken on
record without prejudice to any of the rights of the defendant.
In the connected case titled as Mahender Kumar Thukral vs.
Khalid Salmani vide order dated 26.07.2023, the additional document
filed alongwith replication were taken on record on the ground that the
said documents are essential for the purpose of deciding the real
controversy between the parties. Hence, considering the No Objection of
ld. Counsel for defendant and the documents being relevant to decide the
real controversy between the parties, the said documents are taken on
record.
Further, ld. Counsel for defendant submits that he needs time
to file the affidavit in lieu of admission/denial of documents.
In the interest of justice, time stands granted.
Be filed on the next date and advance copy of same to be
supplied to the opposite party, one week before the next date.
List for admission/denial of documents and framing of issues
on 22.11.2023.
