Affidavit in evidence of counter claimant filed
today.
It is submitted that soft copy has been supplied to
the previous advocate Mr. Prashant Sharma. Copy of the said e
mail has already filed.
Ld. Counsel for noncounter claimant submits that
he has been recently engaged.
Application under Section 151 CPC and application
U/o VIII rule 6 A read with U/o VII rule 10 CPC along with
Vakalatnama filed on behalf of noncounter claimant. Copy
supplied today.
Application U/o VIII rule 6 A read with U/o VII rule
10 CPC is taken up for consideration.
Ld. Counsel for noncounter claimant after going
through the application submits and concedes to the fact that the
present counterclaim which is beyond the pecuniary jurisdiction
of this Court as per the valuation.

Further, Ld. Counsel for counter claimant submits
that counterclaim be accordingly returned to be filed before the
appropriate Court.
Heard. Perused.
Considering that the counterclaimant has sought
recovery of Rs.12,00,000/ in the present counterclaim which is
not within the jurisdiction of this Court, application U/o VIII rule
6 A read with U/o VII rule 10 CPC is allowed and the counter
claim be returned to the counterclaimant as per rules after
making necessary endorsement.
File be consigned to record room as per rules and
after due compliance.
